Welcome to PeerLLM. PeerLLM is operated by BestBytes AI, LLC. These Terms of Service ("Terms") govern your access to and use of the PeerLLM website, platform, host portal, decentralized AI network, and related services (collectively, the "Service").

By accessing or using PeerLLM, creating an account, purchasing tokens, submitting prompts, or participating as a Host, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

1.1 Minimum Age

You must be at least 13 years old to use PeerLLM. If you are under 18, you may use the Service only with the involvement and permission of a parent or legal guardian.

1.2 Account Information

You agree to provide accurate, current, and complete information when creating an account and to keep that information updated.

1.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly if you believe your account has been compromised or used without authorization.

2. Description of the Service

PeerLLM is a distributed AI network that connects users who consume AI services ("Consumers") with independent participants who provide computing resources ("Hosts"). The Service may include AI-powered chat, inference, content generation, model hosting, host performance management, token-based usage, and related features.

2.1 Experimental Nature of the Service

PeerLLM is an experimental and evolving service. Features, pricing, token usage, routing behavior, availability, performance, and functionality may change at any time without notice. The Service may be unstable, interrupted, degraded, limited, or discontinued at any time.

3. Token-Based Access and Payments

3.1 Token-Based Usage

PeerLLM may operate on a token-based usage model. Consumers may purchase tokens to access compute, AI inference, and related services within the PeerLLM network.

PeerLLM may set, modify, or discontinue pricing, token conversion rates, subscription fees, usage terms, and payment structures at any time. Current pricing will be displayed at or before the time of purchase or use where applicable.

3.4 Payment Processing

Payments may be processed through third-party payment providers. By making a purchase, you authorize the applicable payment provider and PeerLLM to process the transaction according to the pricing and billing terms presented to you.

3.5 No Financial Institution Relationship

PeerLLM is not a bank, financial institution, or money transmission service. Any displayed token usage, earnings, payout amounts, or similar values reflect platform calculations for service activity and do not represent stored funds, deposit accounts, or custodial balances.

4. Hosts and Distributed Processing

4.1 Independent Hosts

Hosts are independent participants who contribute computing resources to the network. Hosts are not employees, contractors, agents, partners, or representatives of BestBytes AI, LLC solely by virtue of participating in PeerLLM.

4.2 Separate Host Terms

Host participation is subject to additional terms, policies, and requirements, including any applicable Host Agreement. In the event of a conflict between these Terms and a Host-specific agreement, the Host-specific agreement will control with respect to Host participation.

4.3 Routing and Network Control

PeerLLM controls how requests are routed across the network based on factors such as availability, performance, safety, reliability, redundancy, inspection results, and overall system needs. No Host is guaranteed any minimum traffic, utilization, earnings, or access to requests.

4.4 Host Compensation

If Host compensation is enabled, payouts, thresholds, timing, eligibility, adjustments, reversals, and withholding are governed by the applicable Host Agreement and PeerLLM policies. PeerLLM may adjust, withhold, delay, offset, or reverse compensation in cases of fraud, abuse, policy violations, low-quality performance, chargebacks, refunds, disputes, legal requirements, or network protection.

4.5 No Guarantee of Earnings

PeerLLM does not guarantee any level of earnings, traffic, uptime, workload, or compensation for Hosts. A Host may earn nothing. Operating costs, including hardware, electricity, cooling, bandwidth, and maintenance, may exceed any compensation received.

6.1 Your Inputs

You retain ownership of the prompts, inputs, and materials you submit, subject to any rights necessary for PeerLLM to process them and provide the Service.

6.2 License to Process

By using PeerLLM, you grant PeerLLM the limited rights necessary to screen, anonymize, route, process, transform, divide, transmit, and return your inputs solely for purposes of operating and improving the Service, enforcing policies, protecting the network, and complying with law.

6.3 AI Outputs

AI-generated outputs may be inaccurate, incomplete, biased, offensive, misleading, or unsuitable for your intended purpose. You are solely responsible for reviewing, verifying, and evaluating outputs before relying on them for any decision, publication, professional use, legal use, medical use, financial use, or other consequential purpose.

6.4 Platform Ownership

PeerLLM, its software, branding, website, documentation, host portal, visual assets, and related platform materials are owned by or licensed to BestBytes AI, LLC and are protected by applicable intellectual property laws.

7. Privacy, Anonymization, and Distributed Risk

7.1 Privacy Policy

Your use of the Service is subject to the PeerLLM Privacy Policy, which describes how information is collected, used, disclosed, and protected.

7.2 Distributed Processing Notice

PeerLLM may screen prompts, apply anonymization, divide requests, and distribute task-specific portions of requests across multiple Hosts. While PeerLLM is designed to reduce unnecessary exposure of user data, Hosts operate on independent third-party machines and may be technically capable of inspecting data processed on their systems.

7.3 Sensitive Information

You should not submit highly sensitive, regulated, or confidential information to PeerLLM unless you understand and accept the risks inherent in distributed computing systems.

8. Suspension, Termination, and Enforcement

PeerLLM may suspend, restrict, throttle, investigate, or terminate your access to the Service if we believe, in our sole discretion, that you have violated these Terms, engaged in fraud or abuse, created legal or security risk, threatened the integrity of the network, or where suspension or termination is necessary to protect the Service, our users, Hosts, third parties, or compliance obligations.

We may also remove content, reject prompts, deny token usage, block payouts, restrict Hosts, or take any other action reasonably necessary to protect PeerLLM and its participants.

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR QUIET ENJOYMENT.

9.2 No Warranty of Performance or Availability

PeerLLM does not guarantee uptime, availability, latency, continuity, model quality, output accuracy, output safety, token pricing stability, Host availability, or uninterrupted access to the Service.

9.3 No Warranty of Security or Completeness

Although PeerLLM uses safeguards such as encrypted communications, screening, and anonymization, no system is completely secure, and PeerLLM does not warrant that the Service will be free from errors, vulnerabilities, interruptions, data exposure, or other failures.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTBYTES AI, LLC, ITS AFFILIATES, MEMBERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITY, HARDWARE USE, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTBYTES AI, LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO PEERLLM IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) FIFTY U.S. DOLLARS (US $50).

PeerLLM is not liable for the acts, omissions, failures, misconduct, or independent decisions of Hosts, users, payment providers, cloud providers, model providers, internet providers, or other third parties.

11. Indemnification

You agree to defend, indemnify, and hold harmless BestBytes AI, LLC, its affiliates, members, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and attorneys' fees arising out of or related to your use of the Service, your violation of these Terms, your inputs, your outputs, your violation of law, or your infringement or misuse of any rights of another.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration or, where arbitration is not enforceable or permitted, exclusively in the state or federal courts located in Washington State. You consent to personal jurisdiction and venue in those courts.

13. Changes to These Terms

PeerLLM may update these Terms from time to time. If we make material changes, we may provide notice through the website, platform, or by email. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, Host Agreement where applicable, and any additional terms presented at the point of use, constitute the entire agreement between you and PeerLLM regarding the Service.
